Bottom line, sexually active kids, and young adults, including staff who got their job for the sole purpose of having access to kids, are now going to be able to not only have an excuse for going into the wrong restroom, but a legal leg to stand on to sue anyone who gets offended by it.

By definition, if a highschool boy went into the girls restroom, a week ago, and exposed himself, he'd be a sexoffender.

Now, there are no grounds to pursue.

Also President Obama didn't personally issue the guidance and no students would be forced under its provision to share bathrooms or locker rooms. This is taken directly from Snopes.

So most of this discussion has been based on false premise. Also your comment about the lions-spent enough time in fundie land to know that when you can't make the argument the next best thing is to threaten judgement. Doesn't work with me.

Your post partially illustrates peerophets point....that you don't get the big picture. There are many, many instances of this misguided, common sense less transgender bath-locker-shower room policy leading to cover for perverts.
Title IX is a liberal smokescreen.

The truth of the matter is that Obamas over reach is probably going to turn the tide or at least slow down this process. Ironic, isn't it?

Despite my position on this, I do believe Obama is wrong in threatening to take away funding from public schools as a repercussion. Many kids of poor families depend on those lunches (sometimes other meals as well). The schools, specifically in impoverished areas, would have to bring in tuition money and wouldn't survive. Teachers would be out of a job. Kids wouldn't be able to afford the fees for school supplies. Truancy rates would rise meaning probably more crime/incarcerations/etc.

Too many implications to remove public funding and it would hurt too many people in the long run.

BTW, I realize this is a totally liberal site (which I didn't know existed until this morning, but it sure won't be a staple of mine), the guy makes some valid points concerning this issue:

    1. Transgender students are very rare. Recent research state that only .3% of all 30+ year old adults (3 in 1000) are transgender and some studies conclude the odds of children being openly transgender are as low as 1 in 30,000.

    2. Boys will not walk into a girl?s bathroom under the guise of being transgender. Claiming to be transgender is not a temporary circumstance. Transgender citizens change their ID cards, reflect their gender through dress, and are very consistent with personal identity. Such dishonest behaviors should be met with strict consequences.

    3. My 12 year old daughter will not see a penis in a school bathroom (yes, this was actually used toward my wife as an argument). Just think how that?s even possible. Girl?s bathrooms have stalls, not urinals. It?s also a safe assumption that any student claiming to be transgender is extremely self-conscience given their likely rejection by peers and will retreat to privacy.

    4. Several states, school districts, and corporations have adopted their own policies affirming transgender people?s right to use the bathroom that aligns with their gender identity. None have reported any problems.

    5. Courts have already made rulings on transgender kids and adults using corresponding restrooms in schools and public places. Obviously President Obama overshadowed the judicial branch with his directive, but litigation has already ensued and President Obama is following precedent.

    6. States have full control over their education curriculum and standards. Common core was not implemented by the Department of Education, but by state governments. States can reject the Executive Branch?s directive on transgender students and lose federal funding, which is roughly 9% of educational budgets.

I am not an expert on "exposure law" and I would think it differs somewhat depending on where you are but overall it would be unlawful to expose yourself to someone even in a restroom.

I don't know where you go to the restroom but men in restrooms I use walk over to the urinal do their business and zip up.  A male who went into a women's room would need to use a stall
